However you may choose to go about obtaining a divorce, whether a fixed fee divorce through a lawyer or by self representing, you should be aware that you must be separated for at least twelve months before you may apply for a divorce in Australia.

As well as obtaining your fixed fee divorce, you will want to ensure that you have appropriate parenting arrangements in place. If you have relatively amicable relations with your former partner, a parenting plan may be best to suit your family’s needs and will assist in ensuring that you and your former partner have considered all necessary parenting arrangements for your children. Where you may be having difficulty reaching any agreement with your former partner for the children’s living arrangements or if you have concerns regards the wellbeing of the children in your former partner’s care, obtaining parenting orders may be your best option.

You will also need to obtain a legally binding family law property settlement which may be effected by way of court order or a binding financial agreement. It is important to bear in mind that if you do not obtain such a legally binding family law property settlement within twelve months of your divorce becoming final, you will need to file an action in the family courts seeking final property orders before that twelve month period after your divorce becomes final expires (see section 44 Family Law Act 1975 (Cth)). If you do not do that then after that time, you will have to apply for leave of the family court to be permitted to bring any claim for the division of property before the court.  However, leave is not always granted. This is very important to bear in mind when considering the timing to obtain a divorce, whether a fixed fee divorce through a lawyer or  a divorce that you obtain by self representing.
